Marine Corps National Capital Region courts-martial results

This reports the courts-martial results for Marine Corps commands in the National Capital Region for the period Dec. 29, 2009 through Jan. 28, 2010.

USMC v. Sergeant
On Jan. 15, a general court-martial found a sergeant guilty of four specifications of wrongful use or possession of controlledsubstances, specifically that he wrongfully used cocaine and wrongfully distributed about one-half ounce of crack cocaine, 12 pillscontaining Oxycodone (also known as Percocet), and about 20 pills containing Pregabalin (also known as Lyrica), in violation of Article 112(a), UCMJ, and two specifications of wrongful and recklessconduct, specifically that he willfully and maliciously burned anautomobile with the intent to defraud the insurer thereof and that he wrongfully solicited a fellow Marine to steal, burn, part out, ordestroy the said automobile with the intent to defraud the insurer thereof, in violation of Article 134, UCMJ. The accused was sentenced to confinement for 2 years, a reduction to pay grade E-3, a fine in the amount of $1,000, total forfeitures, and a bad-conduct discharge.

USMC v. Gunnery Sergeant
On Jan. 21, a special court-martial found a gunnery sergeant guilty of four specifications of failure to obey an order or regulation, specifically that he violated lawful general orders byknowingly providing alcohol to a minor and wrongfully engaging in unduly familiar activity with several junior Marines, inviolation of Article 92, UCMJ, and one specification of wrongful conduct, specifically wrongfully having sexual relations with a woman not his wife, in violation of Article 134, UCMJ. Theaccused was sentenced to a reduction to pay grade E-2, and 60 days restriction.

USMC v. Private
On Jan. 25, a special court-martial found a private guilty of one specification of making false official statements, specifically that he made a false official statement to a reporting investigator with the intent to deceive the investigator, in violation of Article 107, UCMJ, and two specifications of larceny and wrongful appropriation, specifically that he stole U.S. currency in the amounts of $500 and $2,504.82 from fellow Marines, in violation of Article 121, UCMJ. The accused was sentenced to confinement for 179 days.
